ABDULLAH PASHA FOUNDATION IS NOT CLOSED, IT CANNOT BE CLOSED!

No foundation can be closed legally, and its immovable properties cannot be transferred to individuals. The Abdullah Pasha Foundation was tried to be closed illegally by the British administration and its properties were seized. We are fighting on this issue in international courts. “The issue of Abdullah Pasha Foundation is a legally complex issue and the Cyprus Foundations Administration's legal battle on this issue has been going on for years. In terms of informing the public, the status of the foundation can be summarized as follows:

• Abdullah Pasha Foundation is a foundation that owns large lands in Famagusta and Karpaz Region. The Property Name, which is the title deed of the foundation, is in our archives.

• In 1907, under the British Administration, decoys began to be issued to people who used the foundation's properties. Ahkam-ül Evkaf laws did not allow this situation. However, the status of the Abdullah Pasha Foundation was misrepresented, and it was accepted as a Öşürlü foundation (only the income was donated), and the assets of this foundation were allowed to be traded in accordance with the land laws.

• With this illegal and wrong practice, the administrators of the period found a way to transfer many valuable lands of this foundation to individuals.

• In 1935, foundations with Öürlü were closed by paying compensation. Abdullah Pasha Foundation was closed in a similar way. However, this transaction was not legal because the Abdullah Pasha Foundation had many assets.

• We know that Abdullah Pasha Foundation has many properties thanks to its name. However, more detailed documents appear with title deed registration numbers in many correspondences between the British Administration and Evkaf regarding the transactions made on the properties of this foundation between 1907 and 1935.

• In the sample document, you can see the correspondence regarding the sale of a property in Famagusta that belongs to the Abdullah Pasha Foundation to the Municipality of Famagusta. On the document, the owner of the property is mentioned as the Abdullah Pasha Foundation. If the Abdullah Pasha Foundation has property, how can it be a charity foundation? We also have other correspondences regarding Abdullah Pasha properties, as in the example.

• As a result, it is clear that the Abdullah Pasha Foundation cannot be closed and its properties cannot be transferred to individuals.

On the other hand, some of the correspondences published by the Cyprus Foundations Administration as a book and found in our archive were presented as evidence in the media reports saying "Abdullah Pasha Foundation in Closed Maraş was closed". However, these news contain false and purposeful statements on many issues:

1. The documents presented in the news are some correspondence of the Director of Foundations in the 1940s and some correspondence in the 1970s. These correspondences are quite inadequate and superficial to understand the foundation's situation. Moreover, by only showing these correspondences, it is as if it is desired to quickly reach the interpretation of "the foundation has been closed".

2. The dissolution of a foundation is not within the jurisdiction of the Director of Foundations. A court order is required.

3. Even if a foundation is closed by wrong decision, it does not mean that the foundation has disappeared. The properties of the foundation can be taken back by legal means.

4. Some of the correspondence is from 1940 and 1944. In the correspondence, it is said that the foundation was closed in 1935 by paying compensation. However, we explained with documents that this closure was unlawful and wrong. In this case, it would be wrong to conclude that it was “closed” just by looking at this correspondence.

5. The other part of the correspondence takes place in the 1970s and refers to the correspondence in 1944.

6. Briefly, the Evkaf Administrations in these periods gave false information to their superiors, saying that "Abdullah Pasha Foundation was closed", without examining the documents sufficiently, only by looking at some correspondences.

In summary, the process initiated in 1907 to usurp foundation properties through legal games continued, with future Awqaf administrators coming to a conclusion without examining the issue in detail. However, it is clear that the Abdullah Pasha Foundation cannot be closed and its properties cannot be transferred to individuals.
